We act solely as forwarding agent. With the exception of the arbitration clause, the most recent version of the Dutch Forwarding Conditions (2004) of the Netherlands Association for Forwarding and Logistics, deposited, inter alia, at the Court of Rotterdam, are also applicable to all our operations as freight forwarder acting on behalf of a principal. A copy of these general terms and conditions is available at http://www.Fenex.nl/Fenex-voorwaarden. We will send you a copy of these conditions free of charge on request. Unless we hear from you to the contrary by return, we shall assume that you are familiar with and agreeable to the content of these conditions. We hereby expressly reject any standard terms and conditions which you may wish to impose. In the case of a possible disagreement as to which conditions apply we ourselves have the exclusive choice in the matter. In the event of a dispute about the capacity in which we act, we ourselves are exclusively competent to make a choice in the matter. Our invoices include commission. Dutch law is applicable to all our operations. The District Court at Roermond is solely competent.
